By accessing or using any Xadira service, website, or tool (collectively, the "Services"), you agree to be bound by these Terms & Conditions. If you do not agree, you may not use our Services. These Terms apply to all visitors, users, and agents who access or use the Services.
Xadira provides a suite of embeddable tools and marketing services designed for licensed Medicare insurance agents, including but not limited to:
You must be at least 18 years of age and a licensed insurance agent (or operate on behalf of one) to use the Services. By using our Services, you represent and warrant that you meet these requirements and that your use complies with all applicable federal and state laws governing insurance sales and marketing.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify Xadira immediately of any unauthorized use. Xadira reserves the right to suspend or terminate accounts that violate these Terms or that are used in a manner inconsistent with applicable law.
Xadira offers monthly and annual subscription plans. By subscribing, you authorize Xadira to charge your payment method on a recurring basis according to your selected plan. Subscriptions automatically renew unless cancelled before the renewal date. All fees are in USD and are non-refundable except as expressly stated in our refund policy or required by law.
Usage-based fees (such as phone, AI, and automation usage) are billed in addition to subscription fees and are outlined separately on the Usage Costs page.
You agree not to use the Services to:
All content, software, designs, and trademarks associated with the Services are the exclusive property of Xadira or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Services for your own insurance agency. No ownership rights are transferred.
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. Xadira does not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Medicare premium and penalty calculator outputs are estimates only and should not be relied upon as legal or financial advice.
To the maximum extent permitted by law, Xadira shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue, arising from your use of or inability to use the Services, even if Xadira has been advised of the possibility of such damages. Xadira's total liability shall not exceed the amounts paid by you in the three months preceding the claim.
Either party may terminate a subscription at any time. Xadira may suspend or terminate your access immediately for violations of these Terms. Upon termination, your right to use the Services ceases and embedded widgets on your website will stop functioning.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Florida.
Xadira reserves the right to update these Terms at any time. We will notify active subscribers of material changes by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
